Washington, D.C. – The Natural Products Association (NPA), a 90-year-old trade association representing
the dietary supplement and natural products industry, applauds the introduction of legislation by
Congressman Nick Langworthy (R-N.Y.). Rep. Langworthy’s bill establishes clear federal preemption for
dietary supplements, reaffirms the authority of the U.S. Food and Drug Administration, and restores the
original intent of the Dietary Supplement Health and Education Act of 1994 (DSHEA).
The legislation would prevent states from imposing conflicting and restrictive requirements on dietary
supplements that undermine federal oversight and limit consumer access to these products.
“For more than 30 years, DSHEA has provided a clear national framework for regulating dietary
supplements under FDA’s authority,” said Jim Emme, Chairman of NPA’s Board of Directors, who also
leads NOW Health Group. “Rep. Langworthy’s legislation supports that framework and would put an end
to a growing patchwork of state laws and bills that threaten to disrupt U.S. commerce and confuse
consumers about FDA oversight of science-backed products with established histories of safe use.”
Over the past several years, multiple states have proposed legislation targeting lawful dietary
supplements, often based on sensationalized claims rather than sound science, and without regard for
FDA’s comprehensive oversight, enforcement authorities and decades of regulatory expertise. The bills
would result in a patchwork of inconsistent and, in certain cases, contradictory rules, unduly restricting
consumer access to dietary supplements and exposing reputable retailers to increased liability.
“This bill is about protecting the rights of consumers to access safe products like creatine and branch
chain amino acids and the rights of established, reputable companies to sell them,” said Daniel Fabricant,
Ph.D., president and CEO of NPA. “Americans deserve uniform access to affordable supplements
regardless of where they live. Companies deserve regulatory certainty so they can invest in quality,
innovation and compliance.”
