California State Assembly Renews Push to Restrict Access to Supplements Despite Governor Newsom’s Veto of Same Approach

Washington, D.C. – Despite intense lobbying efforts by NPA in 2022 to secure a veto by Governor Gavin Newsom, the California State Assembly Health Committee advanced AB 82, which would restrict and prohibit access to dietary supplements.

“The NPA has worked in good faith with the California Department of Public Health to educate them on dietary supplement safety, efficacy, and regulations,” said Daniel Fabricant, Ph.D., president and CEO of the NPA. “As we have seen across the country, there are legislators who ignore the realities of science to promote their agenda. As we have demonstrated repeatedly in public testimony and official correspondence to the Governor and to California public health officials, there is not a single data point connecting the use of eating disorders and dietary supplements. If there were, the FDA would be required to remove that product from the market.”

The NPA has battled this proposal and others nationwide, submitting testimony for the record, engaging grassroots campaigns, and collaborating with state executives to help them better understand the dietary supplement industry. In New York, the NPA recently filed a lawsuit against the state for its newly enacted law to restrict and prohibit access to dietary supplements.
