Under the rule, manufacturers are required to evaluate the identity, purity, quality, strength, and composition of their dietary ingredients and dietary supplements. GMPs are crucial to the supplement industry’s ability to deliver safe, accurately labeled products to the consumer and in achieving the public health benefits noted by Congress in the preamble to the Dietary Supplement Health and Education Act of 1994.
- [Regulatory](https://www.npanational.org/regulatory/): The U.S. Food and Drug Administration’s (FDA’s) Center for Food Safety and Applied Nutrition (CFSAN) regulates most natural products, ranging from conventional foods and dietary supplements to cosmetics, with respect to public health. FDA is statutorily empowered to provide administrative guidance on the Federal Food Drug and Cosmetic Act’s broad mandates and to enforce the Act through administrative actions. FDA can draft and finalize guidance, which is their thinking on a particular topic. They can issue draft and final regulations, which have the same force as Congressional law, through a public notice and comment rule-making process. They can issue advisory actions in the form of untitled letters and warning letters to achieve voluntary compliance and to establish prior notice. Finally, FDA can coordinate with the Department of Justice to enforce the Federal Food, Drug, and Cosmetic Act with final agency action through product seizures, injunctions, civil penalty proceedings, or criminal prosecutions.

- [Oppose the Food Labeling Modernization Act of 2018 (H.R. 5425)](https://www.npanational.org/resource/oppose-the-food-labeling-modernization-act-of-2018-h-r-5425/): While the natural products industry is appreciative of efforts to include the definition of natural for foods as well as exempt dietary supplements from rulemaking relating "natural" on the labeling of food, the natural industry already has to deal with biotech/GMO labeling and updates to the Nutrition and Supplement Facts panel. The compliance dates for these other labeling changes made through final rulemaking are still in flux at the moment.

- [No Fees for Dietary Supplements in Puerto Rico](https://www.npanational.org/resource/no-fees-for-dietary-supplements-in-puerto-rico/): On February 9th, 2016, the Puerto Rican Secretary of Health issued Administrative Order #346 ("Order"), imposed a regulatory scheme in Puerto Rico for all retailers and distributors of dietary supplements in Puerto Rico -- all without approval from Puerto Rico's legislature and without any prior notice and comment period. This Order imposed fees and represented a money grab. NPA fought to execute a stay as part of PROMESA, an economic bailout of this U.S. territory. There are threats from the State Senate and Assembly of Puerto Rico to impose similar registration fees and requirements again, only for retailers of dietary supplements (drug stores would be exempt). These proposals add no public health value as much as what has been proposed already mirrors much of what is already currently filed with U.S. FDA.
- [U.S. Food and Drug Administration (FDA) Protein Content Food Labeling Fix](https://www.npanational.org/resource/u-s-food-and-drug-administration-fda-protein-content-food-labeling-fix/): Under title 21 of the Codified Federal Regulations (21 C.F.R) Section 101.9(c)(7), nitrogen-containing compounds that are not used in protein synthesis can be used toward the calculation of protein content. "Protein content may be calculated on the basis of the factor 6.25 times the nitrogen content of the food as determined by the appropriate method of analysis... except when official AOAC procedures... require a specific factor other than 6.25, that specific factor shall be used." While some of these N-containing compounds are considered to be amino acids by FDA (ie. L-citrulline and L-ornithine), they are not incorporated into protein from amino acid building blocks. FDA can clarify the regulation on calcuation of protein content so that consumers are not misled into thinking protein is in a finished product as opposed to a nitrogen-containing compound.
- [How Dietary Supplements (Foods) Became Regulated](https://www.npanational.org/resource/dietary-supplements-foods-became-regulated/): The history of food and dietary supplement regulation began with Dr. Harvey Washington Wiley, who is affectionately known as the “Father of the FDA”. Dr. Wiley was born in a log cabin in 1844 on a frontier farm in Kent, Indiana. Wiley spent his early years helping to plant and harvest crops on his family farm. He studied at Hanover College starting in 1863 until he enlisted with the Union Army with the Indiana Volunteers. He returned to Hanover College and received a Masters of Arts. Wiley received a medical degree at Indiana Medical College in 1871 and a bachelor’s degree at Harvard in 1873. By his late 30s, he was a professor of chemistry at Purdue University, beginning in 1874.

- [New Dietary Ingredient Draft Guidance](https://www.npanational.org/resource/new-dietary-ingredient-draft-guidance/): In the Dietary Supplement Health and Education Act of 1994 (DSHEA), a new dietary ingredient (NDI) is defined as “a dietary ingredient that was not marketed in the United States before October 15, 1994 and does not include any dietary ingredient which was marketed in the United States before October 15, 1994.” Dietary supplements marketed before October 1994 are grandfathered if the company can establish that same form or dosage was on the market and the dietary supplement does not contain adulterated ingredients.

A “medical food” is “a food which is formulated to be consumed or administered enterally under the supervision of a physician and which is intended for the specific dietary management of a disease or condition for which distinctive nutritional requirements, based on recognized scientific principles, are established by medical evaluation.”
